Terms of Service
1. Acceptance and Scope
By registering on the Zanthex platform or using our services, you accept these Terms of Service. If you do not agree, do not use the platform. For users acting for commercial or professional purposes, the Turkish Code of Obligations and the Turkish Commercial Code apply; for consumers, the Consumer Protection Law No. 6502 applies.
2. Service Description
Zanthex is a SaaS (Software as a Service) platform that provides AI-powered voice and text customer service solutions to businesses. The service scope includes chatbot, voice assistant, call center, knowledge base management, and customer communication tools.
3. Account Obligations
- Provide accurate, complete, and up-to-date information during registration
- Maintain the security of your account credentials (email, password)
- Do not share your login credentials with third parties
- Immediately report any unauthorized access or security breaches
The account holder is responsible for all actions performed under their account.
4. Usage Rules
You must use the platform in compliance with applicable laws and these terms. The following actions are strictly prohibited:
- Creating or transmitting illegal, obscene, defamatory, or spam content
- Attempting to harm the platform's infrastructure, security systems, or other users
- Violating third-party intellectual property rights
- Abusing the platform with automated tools (bots, scrapers, etc.)
- Using the platform for fraud, phishing, or similar deceptive purposes
- Resource consumption exceeding the fair usage policy
5. Prepaid Credit System and Payment
The platform operates on a prepaid credit system similar to a telecommunications operator model.
- Users load credits to their account; each service usage (calls, messages, API calls, etc.) is instantly deducted from the balance.
- Loaded credit balance is non-refundable. Upon credit loading, the service is immediately made available for use; no refund can be requested for unused balance.
- Invoices are issued for credit loading transactions.
- The price tariff is published on the platform. Tariff changes are announced at least 7 days in advance; credits loaded before the change are consumed at the previous tariff rate.
6. Service Level
We target 99.9% availability for the platform. Planned maintenance is announced at least 24 hours in advance. SLA (Service Level Agreement) terms apply for outages excluding planned maintenance and force majeure events.
7. Intellectual Property
- The platform software, interface, design, algorithms, and all technological components are the intellectual property of Zanthex.
- Content uploaded or created by users on the platform (knowledge base, bot configurations, call recordings, etc.) belongs to the user.
- Reverse engineering, decompilation, copying, or creating derivative works from the platform is strictly prohibited.
- The Zanthex name, logo, and registered trademarks may not be used without authorization.
8. AI Services Limitation of Liability
The platform's AI-powered services (chatbot responses, voice assistant outputs, etc.) are for informational purposes and do not substitute for professional legal, medical, or financial advice. The accuracy of AI outputs cannot be guaranteed; users evaluate these outputs at their own responsibility.
9. General Limitation of Liability
The PROVIDER's total liability arising from this agreement is limited to the amount paid by the user in the last 12 months. No liability is accepted for indirect, incidental, or consequential damages including loss of profit, business loss, or data loss.
10. Account Suspension and Termination
- In case of terms violation, the PROVIDER may suspend or terminate the account without prior notice.
- Users may request to close their account at any time.
- After account closure, user data is deleted within 30 days, subject to legal retention obligations.
- Remaining balance is non-refundable upon account closure or suspension.
11. Privacy and Data Protection
Details regarding the processing of personal data are set out in our Privacy Policy and Data Protection Notice. These documents form an integral part of these Terms of Service.
12. Modifications
The PROVIDER may update these terms with prior notice. Significant changes are announced at least 15 days in advance via email and/or in-platform notification. Continuing to use the platform after changes constitutes your acceptance of the updated terms.
13. Governing Law and Disputes
These terms are governed by the laws of the Republic of Turkey. Mediation is mandatory before filing a lawsuit. For consumer transactions, the relevant Consumer Arbitration Committees and Consumer Courts have jurisdiction; for commercial transactions, Istanbul Courts and Enforcement Offices have jurisdiction.
